Terms of Use (EULA)
These terms are an agreement between you and Inappbot Inc. ("we"), based in the Bronx, New York, for using Abuelito Driving School (driving and CDL), Abuelito Citizenship, Abuelito English, abuelito.co and the web app (together, "the apps"). By using them you accept these terms. If you don't agree, don't use them.
1. If you downloaded the app from the App Store
The license for the iPhone apps is Apple's standard Licensed Application End User License Agreement ("Apple EULA"). These terms supplement it (account, passes, refunds, use of the content); if anything here conflicts with the Apple EULA regarding the license of the iPhone app, the Apple EULA controls. In addition:
- This agreement is between you and us, not Apple. We, not Apple, are responsible for the app and its content, for maintaining and supporting it, and for handling any claims about it (product liability, legal compliance or third-party intellectual property).
- If the app fails to meet a warranty required by law, you may notify Apple and Apple will refund the purchase price of the app (if any); beyond that, Apple has no other warranty obligation.
- You must follow the App Store usage rules and your carrier's or internet provider's terms.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
2. What the apps are (and are not)
They are educational tools to practice for the driver's test, the citizenship interview and English. We are not the government: we are not affiliated with the DMV, USCIS or any agency, and we do not give legal advice. Practice tests are not the official tests and practicing does not guarantee you will pass. Read the independence notice. For your own case, talk to an immigration attorney or accredited representative, and always check the official source.
3. Age
You must be 13 or older. If you are a minor in your state, use the apps with permission from a parent or guardian, who accepts these terms for you.
4. Your account (optional)
- All free features work without an account. The account saves your progress, lets you use it on another device and keeps your passes.
- You sign in with a code sent to your email or with Sign in with Apple. It is personal: don't share it. It works on 2 phones at a time; signing in on a third one signs out the oldest.
- You are responsible for activity on your account and for keeping access to your email.
- You can delete it anytime in Profile → "Your account" → "Delete my account" or as explained in Delete my account.
- We may suspend or close an account used to abuse the service, resell or share passes, or break these terms; if it was our mistake, we will refund what is fair.
5. Free features
Free features may have limits (for example, a number of practices per day or week) that the app shows. The official question lists and all legal information are always free. We may change what is free; we will not take away what you already bought.
6. Passes (one-time payments)
When the apps offer them:
- A pass is a one-time payment that does NOT renew and never charges you again. On the App Store it is a "non-renewing subscription". The purchase sheet shows the total price, what it includes and how long it lasts:
- Driving Pass and CDL Pass: until you pass, for up to 12 months from purchase.
- Citizenship Pass and Citizenship for two: until your oath, for up to 18 months from purchase.
- English Pass: 12 months from purchase.
- Abuelito Pass and Family Pass: all courses; each course's time counts from when you start it, as the purchase sheet says.
- Free extension (guarantee): if your driving, CDL or citizenship pass runs out before your test because you couldn't get an appointment in time, or if you don't pass, email [email protected] before it ends or within 30 days after, and we will extend it for free once, for the same length of time. We may ask for simple proof (for example, the appointment or result letter), without unnecessary data.
- Family Pass: up to 4 people, each with their own account. The buyer manages it and can swap one person once a year. It does not use Apple's Family Sharing. Citizenship for two: 2 people, same rules.
- Personal use: passes are for you (or the people on your pass). They can't be resold, rented, or used by sharing an account.
- Where you pay: on iPhone, Apple charges your Apple ID; on abuelito.co, Stripe charges your card. Taxes are included or added depending on your state, as the store shows. The pass lives in your account and works in every Abuelito app you sign in to with it.
- Restore purchases: if you change phones, sign in with the same account and tap "Restore purchases".
7. Refunds
Apple refunds App Store purchases (reportaproblem.apple.com); we refund abuelito.co purchases through Stripe. If you are refunded, the pass is canceled. Details in the refund policy.
8. Acceptable use
You may use the apps to learn and share their links. You may not: copy, bulk-download, resell or publish our content (lessons, questions, voices, videos, drawings, characters); use it to train artificial intelligence models; impersonate us or the government; break into, overload or reverse-engineer the apps or the server; or use them for anything illegal.
9. Intellectual property
The apps, the "Abuelito" brand, the characters (Abuelito, Rafa and the officers), the texts, voices, videos and drawings belong to Inappbot Inc. or its licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use them inside the apps. The official USCIS lists are public works of the US government; state laws and handbooks belong to their agencies. Third-party software notices are in Licenses.
10. Information, links and availability
We review everything carefully and cite official sources, but laws and tests change and mistakes happen: the official source always has the final word. When driving, obey the law and the signs; do not use your phone while driving. Links to other sites have their own rules. We may change, improve or stop offering parts of the apps; if we stop offering something you paid for before your pass ends, we will give you a prorated refund or something equivalent.
11. No warranties and limitation of liability
To the extent the law allows, the apps are provided "as is" and "as available", without warranties of any kind (for example, that you will pass or that they will never fail). To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, opportunities or profits, and our total liability for anything related to the apps will not exceed what you paid us in the last 12 months or US$50, whichever is greater. Some laws don't allow these limits; in that case they apply only as far as the law allows. Nothing here takes away rights the law gives you that cannot be waived.
12. Indemnity
If you use the apps in breach of these terms or the law and that causes a third-party claim against us, you will cover the reasonable costs of that claim, to the extent the law allows.
13. Governing law and courts
These terms are governed by the laws of the State of New York and US federal law, without applying conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Bronx County or New York City, and we both accept their jurisdiction; you may also use the small-claims court where you live. Before suing, email [email protected]: almost everything gets solved that way. If you live in a state whose consumer law gives you more protection, that protection still applies.
14. Ending the agreement
You may stop using the apps and delete your account anytime. We may end this agreement if you break these terms. Sections that by their nature should survive (ownership, liability limits, governing law) survive.
15. Changes
If we change these terms we update the date and version at the top; for important changes we tell you in the app before they apply. If you keep using the apps afterwards, you accept the change.
